Please read these Terms of Use carefully before using this website. By accessing or using bloomingarcpsychiatry.com (the "Site"), you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. About This Site
This Site is owned and operated by Blooming Arc Psychiatric Care PLLC ("we," "us," or "our practice"), a psychiatric practice located in Houston, Texas.
The Site exists to provide general information about our practice, our services, and mental health topics, and to allow prospective and current patients to request appointments and contact us.
2. No Medical Advice
The content on this Site is for general informational and educational purposes only. It is not medical advice, and it is not a substitute for evaluation, diagnosis, or treatment by a qualified health care professional.
Nothing on this Site — including blog posts, service descriptions, condition summaries, and frequently asked questions — should be relied upon to diagnose a condition, select or adjust a medication, or make any decision about your health or the health of another person.
Never disregard professional medical advice or delay seeking it because of something you read here. Always consult your own qualified clinician about your individual circumstances.
3. No Provider-Patient Relationship
Using this Site does not create a provider-patient relationship between you and our practice.
Visiting the Site, reading its content, submitting a contact form, sending us an email or text message, or requesting an appointment does not establish a clinical relationship and does not obligate us to provide care.
A provider-patient relationship is established only after all of the following have occurred:
You have been accepted as a patient by our practice;
You have completed and signed our intake and consent documents; and
You have attended a scheduled initial psychiatric evaluation with our provider.
Until those steps are complete, we cannot and will not provide clinical guidance, prescriptions, refills, or crisis intervention.
4. Emergencies
This Site is not monitored continuously and must never be used for emergencies.
If you or someone else is experiencing a psychiatric or medical emergency, or if there is a risk of harm to yourself or another person, do not use this Site, email, or text message. Instead:

Go to your nearest emergency room
We do not provide emergency services, crisis response, or after-hours urgent care through this Site or through any electronic message.
5. Where We Are Licensed to Provide Care
Our provider is licensed to practice in Texas, Connecticut, New Hampshire, and Florida. We may provide clinical services only to patients who are physically located in one of those states at the time of the appointment.
This is a legal requirement, not a preference. If you relocate or travel outside these states, we may be unable to see you until you return. Please tell us in advance if your location will change.
The availability of this Site in other states or countries does not mean we are able to accept you as a patient there, and nothing on this Site should be interpreted as an offer to provide care where we are not licensed.
6. Appointment Requests and Scheduling
Appointment requests submitted through this Site or through our patient portal are requests only and are not confirmed until we notify you directly.
We do not guarantee appointment availability, a specific appointment time, or acceptance as a new patient. We reserve the right to decline to accept any individual as a patient, consistent with applicable law and professional obligations.
Scheduling, intake paperwork, and payment are handled through our third-party patient portal. Your use of that portal is governed by its own terms and privacy policy in addition to these Terms.
7. Prescriptions
We do not prescribe medication through this Site.
Prescriptions are issued only following a clinical evaluation and only where clinically appropriate, in accordance with federal and state law and our professional judgment. Submitting a form or message through the Site does not constitute a request for a prescription and will not result in one.
Requests for medication refills must be made through the patient portal or by contacting our office directly, and are subject to our refill policies and any required follow-up appointments.
8. Electronic Communications
Email. Standard email is not secure. Do not send sensitive health information by unencrypted email. Messages sent to us through the Site are not encrypted end-to-end.
Text messaging. By providing your mobile number and opting in through our web form or intake paperwork, you agree to receive SMS messages from Blooming Arc Psychiatric Care for customer care, including appointment reminders, scheduling follow-up, and administrative messages. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out. Reply HELP for assistance, or visit https://www.bloomingarc.com. SMS consent is not shared with third parties or affiliates.
Response times. We do not guarantee that any message sent through the Site, by email, or by text will be received, read, or answered within any particular time frame. Do not use these channels for anything time-sensitive.
Patient portal. Clinical communication should take place through our secure patient portal, not through the Site's contact forms.
9. Privacy
Our collection and use of information through this Site is described in our Privacy Policy. Our handling of protected health information as a HIPAA covered entity is described in our Notice of Privacy Practices. Both are incorporated into these Terms by reference.
10. Intellectual Property
All content on this Site — including text, copy, graphics, logos, photographs, design elements, and the arrangement of them — is owned by our practice or used under license and is protected by copyright, trademark, and other laws.
You may view and print Site content for your own personal, non-commercial use. You may not reproduce, republish, distribute, modify, or create derivative works from Site content, or use it for any commercial purpose, without our prior written permission.
11. Acceptable Use
When using this Site, you agree not to:
Use the Site for any unlawful purpose or in violation of these Terms

13. Blog and Educational Content
Blog posts and educational articles on this Site reflect general information current as of the date of publication. Medical knowledge and clinical guidelines change, and we do not undertake to update prior posts.
Blog content is general in nature, is not tailored to any individual, and does not create a provider-patient relationship. It is not a substitute for an evaluation.
14. Testimonials and Reviews
We do not publish patient testimonials on this Site. We do not solicit reviews from patients, and we do not offer any incentive in exchange for a review.
Any third-party reviews that appear elsewhere on the internet reflect the views of the individuals who wrote them, are not verified by us, and do not predict the outcome of any individual's care. Patient outcomes vary, and no result is guaranteed.

16. Disclaimer of Warranties

17. Limitation of Liability
To the fullest extent permitted by law, our practice and its owner, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, this Site — including damages for loss of data, loss of profits, or personal injury — even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred dollars ($100.00).
Nothing in these Terms limits or excludes liability for professional negligence in the delivery of clinical care, for gross negligence, for willful misconduct, or for any other liability that cannot lawfully be limited. These Terms govern your use of the website only and do not alter the professional obligations we owe to our patients.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply only to the extent permitted.
18. Indemnification
You agree to indemnify and hold harmless our practice and its owner, employees, and contractors from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site, or your violation of the rights of any third party.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the jurisdiction of those courts.
If you are a resident of another state, you may have rights under the consumer protection laws of your state that cannot be waived by this provision, and nothing here is intended to limit those rights.
20. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Our failure to enforce any provision is not a waiver of our right to enforce it later.
21. Minors
This Site is intended for use by adults. If you are under 18, please do not use this Site without the involvement of a parent or legal guardian.
We provide psychiatric care to patients beginning at age 5, but appointment requests and intake paperwork for a minor must be submitted by a parent or legal guardian with authority to consent to the minor's care.
We do not knowingly collect personal information from children through this Site.
22. Changes to These Terms
We may update these Terms at any time. The revised version will be posted on this page with a new effective date, and it takes effect when posted. Your continued use of the Site after that date means you accept the updated Terms. Please review this page periodically.
